L-Drivers Ltd – Agreement

​Please read our Terms & Conditions of Service carefully.

​By booking a driving lesson, or course of driving lessons with L-Drivers Ltd you are confirming that you have read and understood L-Drivers Ltd.’s terms and conditions as set out below, and you agree to be bound by them.

​All bookings are accepted on the STRICT understanding that the pupil has read, understood and accepted the terms and conditions as set out below.

Definitions:

​• ‘you’ means the pupil

• ‘we’ ‘us’ means L-Drivers Ltd

• ‘the driving school’ means the driving school or driving instructor providing the course for you on behalf of L-Drivers Ltd

• ‘the instructor’ means a driving instructor acting on behalf of the driving school when providing the driving lesson, or driving course

 General Terms & Conditions:

​1. Each individual driving lesson or driving course is and lasts for, the total number of hours booked for that lesson or course. In the case of a course, the total hours of the course booked, includes 2 hours to attend a practical test.

​[For your information, you are required to arrive at the test centre 10 minutes prior to the start of your test and allow approximately 1 hour for the test itself. Travel time from the test centre to your home is chargeable at the standard hourly rate (as agreed with your instructor), if required, and is obviously dependent on location. Additional hours can be booked with your instructor at his/her advertised hourly rate (this can be agreed between you the pupil and your instructor, prices are regional dependent)].

​2. If transport to and from a theory test centre is required during a lesson, this will form part of your lesson (including the time taken to complete the test) and is chargeable at the instructor's hourly rate.

​3. All pupils must pass the legally required eye sight test by correctly reading a number plate at a distance of 20.5m or 67 ft. At the start of your first driving lesson, your driving instructor will ask you to do this. Should you fail this eyesight check, the lesson or course will be abandoned until you have corrected your eyesight. Any, and all, previously agreed hours which have been booked in with the instructor but which cannot commence due to poor eyesight, will be lost. These are non-refundable.

​4. Lessons must be paid for in advance and no later than 2 hours prior to start of the lesson. Payment will be taken via PayPal using it's credit / debit card handling facilities and secure payment gateway.

​YOU DO NOT NEED TO HAVE A PAYPAL ACCOUNT TO MAKE PAYMENT.

​Invoices for lessons and subsequent payment reminders will be sent in good time prior to the start of the lesson, giving plenty of opportunity for the client to make payment as per our terms stated above. Should the client fail to do so, and there has been no effort on the part of the client to reply to these reminders, the lesson will not proceed and will be treated as a short notice cancellation. As such, and as part of our cancellation policy, the cancelled lesson will be chargeable to the pupil.

​Any and all lesson fees or course fees paid by the pupil, are non-refundable unless we cannot provide an instructor for the dates that have been mutually agreed.

​5. Where a deposit has been paid by the pupil to secure a pre-arranged driving lesson or course, and the pupil then cancels that lesson or course within 72 hours of the confirmed lesson due date, then that driving lesson or course will be forfeited and the time lost at the pupil's sole expense. The deposit paid is non-refundable.

​Where a deposit has NOT been paid by the pupil to secure a pre-arranged driving lesson or course, and the pupil then cancels that lesson or course within 72 hours of the confirmed lesson due date, then the cost of that driving lesson or course in its entirety will remain due by the pupil until such time as it has been paid in full to the driving instructor or driving school with whom the booking was made.

If a pupil books additional hours with the instructor and then cancels or fails to show, and that cancellation occurs less than 72 hours from the confirmed start date, then those hours will be charged in full to the pupil and made payable to the driving instructor at the agreed hourly rate or at a rate of £25 per hour whichever is the greater.

​By providing the driving instructor or driving school with your personal details and specifically your driving license number as part of the booking process, you agree to abide by these terms and conditions.

​6. A 'successful booking' is when an ADI (approved driving instructor) is allocated to the pupil and both agree to begin the driving lesson or driving course.

​7. All courses listed on the lesson & prices page of our website are designed based upon average learning capabilities from past client experience. The actual time taken for an individual pupil to successfully complete a course and be classed as test ready is dependent on the specific learning capabilities of that pupil. Additional time may be required to bring the pupil up to test standard and allowances should be made by the pupil if this proves to be the case. No guarantees can be made or implied by any advisor or instructor.

​You should be prepared for extra tuition if it is felt that it is required before you are permitted to safely attend the driving test.

8. A practical driving test cannot be booked until the pupil has successfully passed the theory test and we have been informed of the theory pass number.

9. In the case of courses, practical test availability is subject to tests made available by the Driver and Vehicle Standards Agency (DVSA). Reasonable attempts will be made by us to secure a practical test local to the pupil. If no test slots become available for the final day of the course, the pupil may request to save a few hours and return a following week to take their test, once a suitable test slot has been found. Test centres may be closed on weekends and bank holidays. We cannot guarantee a test for any specific day but normally get one at the end of a course week or early the week after if the test centre is fully operational. Please be aware this may require more of your time to complete the driving course at a later date than you originally planned.

10. The contract governing individual driving lessons or courses (in which ever format is chosen by the pupil), is between the pupil and the appointed driving instructor. Any disputes or claims should therefore be taken up with the instructor firstly and not L-Drivers Ltd unless the instructor is directly employed with L-Drivers Ltd. L-Drivers Ltd cannot be held liable for any compensation claim from a pupil, nor can it be held responsible for any traffic violation on the part of the pupil or the instructor, unless the instructor is directly employed with L-Drivers Ltd. L-Drivers Ltd acts for the most part as a booking agent on behalf of it's franchisees and is paid on commission by it's franchisees and their instructors for arranging successful bookings.

​11. The fee due for any and all lesson(s) / course(s) is payable directly to your allocated instructor, and is due prior to the start of the lesson / course. Failure to pay the fee for that course prior to the first lesson commencing or as requested, will result in immediate course cancellation whilst the fee will still remain due. Should you pay the fee directly to L-Drivers Ltd, we would only be acting as an intermediary, and would then transfer the money to your allocated instructor, unless your instructor is directly employed by L-Drivers Ltd.

​12. In the unlikely event that we cannot fulfil your booking and allocate you an instructor, a full refund of the fees paid over will be issued.

13. In the unlikely event of the instructor’s vehicle breaking down during the lesson or course, a refund of the outstanding lesson time and outstanding test fees will be made if an alternative instructor cannot be arranged. Lessons taken will be charged at the standard hourly rate of £25.00 per hour.

14. L-Drivers Ltd, it's franchisees and your driving instructor, cannot be held liable for any losses resulting in course cancellation or test cancellation due to any of the following reasons - bad weather (for example: severe flooding, snow or ice), examiner illness, or examiner strike. Should a lesson / course be cancelled by your instructor due to ill-health, or vehicle breakdown, your instructor will arrange another date to complete the course. Should a practical driving test have to be cancelled as a direct result of an instructor's in ability to provide the lessons or course as pre-arranged, then the instructor will either re-arrange the practical driving test, or recompense the pupil for the cost of the cancelled driving test if it is not possible to re-arrange a test date.

15. Please do not make any travel, accommodation, or time-off work arrangements until you have spoken to your appointed instructor and discussed and confirmed your schedule. All bookings are classed as provisional only until they have been confirmed by your allocated driving instructor. Please bear in mind that all our instructors are extremely busy at this time, and that it may not be possible to commence your lesson / course on your preferred start date. We will endeavor to arrange your lesson / course as near to your preferred start date as possible.

The Individual Lesson / Course:

1. All lessons and courses are undertaken with a DVSA approved driving instructor (ADI), and strictly on a one pupil to one instructor basis.

2. We do not offer shared courses e.g. 2 pupils in the car.

3. No guarantee can be made of test availability, especially if your theory certificate is about to expire (it is valid for 2 years). In the event that a test cannot be booked for the end of the course, then an alternative test will be offered for a date and time agreeable to the pupil and instructor. No refunds of any monies are applicable in this case. Also, if the DVSA cancels a test for whatever reason, we cannot be held responsible / liable for the test fee and any lesson time lost, you may need to purchase additional lessons to retake the test. You may be able to claim reimbursement of some lesson time off the DVSA in certain circumstances.

4. Whilst every effort is made to get the pupil to the required level to take the driving test, if it is thought by the instructor that the pupil’s standard of driving falls below the expected standard, then for the health and safety of the pupil, examiner and general public, the pupil will not be allowed to take the test. No refund will be made in these circumstances.

5. All our instructors have been approved or licensed by the Driving and Vehicle Standards Agency.

6. The car provided by the instructor will be comprehensively insured with a reputable insurer. A pupil can request to see insurance documentation from their instructor at any time. L-Drivers Ltd cannot be held responsible for any insurance related claims. Any disputes are the responsibility of the instructor.

7. The driving instructor will not smoke in the training vehicle.

8. Refreshment breaks will form part of your daily tuition period in the case of intensive courses and as agreed between you and the instructor.

9. The driving instructor will not use a mobile telephone, except in an emergency, or in the interest of, or with the permission of the pupil.

10. The training vehicle will be in good working order and will be fitted with dual controls.

11. All special offers and course/lesson prices are subject to change without notice and are at the discretion of the company.

12. If a gift voucher is supplied by L-Drivers Ltd, then the voucher is valid for a maximum period of 6 months from the date of issue. Gift vouchers are to be used by the person, or persons named on the voucher and are non-transferable.

13. If payment is received by an instructor for a course of lessons and the pupil does not complete that said course, then the remaining hours are valid for a period of 1 calendar month from the date of the last completed lesson. After this time, the lessons and test fees will be forfeited and no refund will be given.

14. When a pupil is successful and passes their practical driving test, any unused hours may only be refunded at the discretion of the instructor. The calculation of any refund will be based on the hours utilized being charged at the hourly rate as specified at the time when the booking was made.

Theory Test & Practical Driving Test:

1. If your instructor feels that you are not ready to take your practical driving test, due to safety reasons and/or a lack of necessary competence, then you the pupil will not be allowed to take your driving test in the instructor's vehicle. This is a stipulation set by the Driving & Vehicle Standards Agency (DVSA).
If this proves to be the case, you may lose your test fee and will not be offered a refund. It is therefore extremely important to discuss the booking of a test with your instructor prior to doing so.

2. The prices quoted on the lessons & prices page of our website with particular relevance to the courses provided, include the cost of practical driving tests where stated. Should you book these yourself, the current prices as charged by the DVSA (subject to their terms and conditions) can be seen below:

Theory test: £23 (weekdays) - £23 (evenings, weekends, & bank holidays)

Abridged (conditions apply) Theory test: £18 (weekdays) - £18 (evenings, weekends, & bank holidays)
Driving test: £62 (weekdays) - £75 (evenings, weekends, & bank holidays)
Extended driving test for disqualified drivers: £124 (weekdays) - £150 (evenings, weekends, & bank holidays)

Your Obligations:

1. You must be able to satisfy the driving test eyesight requirements, meaning that you must be able to correctly read a number plate at a distance of 20.5m or 67ft.

2. You satisfy the DSVA requirements regarding residency and eligibility requirements.

3. You fill out the booking form correctly so that we can carry out our administration duties.

4. You make us aware before making a booking, of any health issues either mental or physical which may affect your ability to perform as expected on an intensive driving course.

5. You agree the lesson dates / full course hours and make a note of the hours that have been agreed with the driving instructor (minus the final few hours if we need to save some for a driving test to be arranged) on the initial phone call with the instructor. If these are not satisfactory please call us at this point so that we can arrange an alternative instructor or discuss alternatives. If we are notified at the office, once the course has begun that you cannot do certain times and dates, or the instructor cannot complete the course with you in a certain time scale, then we are powerless to try to move the course to another local instructor.

6. You agree to book time-off work, or make travel, or accommodation arrangements. only once the hours have been agreed in full with an instructor who has called you and confirmed a detailed lesson schedule.

7. You agree to pay all invoices for driving lessons on time and at least 2 hours prior to the start of the driving lesson.

8. You attend your lessons on time. Failure to do so will result in you losing time and the driving school/instructor has no obligation in such circumstances to add time to the end of your lesson. The instructor will wait for 20 minutes for a pupil at the agreed meeting point, if you are not in the car within 20 minutes of the agreed meeting time, and haven't made contact with your instructor, we will assume the lesson has been terminated with you and move on to another lesson. The instructor is under no obligation to add this time on at the end of the course and the time will be forfeited.

9. You attend the theory test and practical test on time and take both parts of a valid provisional driving license with you when you attend. Theory test booking conformations will be sent via email to the email address you provide for us on your booking form. Failure to attend will result in loss of the test fee and you will have to pay for the next one.

10. You email us, or text us with your theory pass number as soon as you pass it, so that we can book a practical test on the same day and begin the process of finding you a driving test cancellation.

11. You must not be under the influence of drink or drugs at any time during your course. If we, your instructor, or a representative of L-Drivers Ltd, suspect or detect any sign of this, the remainder of the course will be terminated and you will lose all fees paid.

12. A professional approach is required by the pupil and no abusive behaviour towards the instructor will be tolerated. The course will be terminated and any monies paid will be forfeited in such an event.

13. You supply on the first lesson a signed provisional driving licence. If you fail to produce a valid provisional driving licence, the driving school / instructor cannot by law permit you to drive a car and accordingly your booking will be cancelled and any fees forfeited.

14. The construction, validity and performance of any contract shall be governed in all respects by the laws of England and Wales.

Damage to the tuition car:

During lessons, your instructor will make every effort to avoid damage to the car. However, if he considers that you were driving in a dangerous or unpredictable way during a lesson and actual damage is caused despite best efforts made, you will be expected to pay half towards repairs (up to the level of excess on the instructor’s insurance policy). This will be discussed at the time of the damage. If the interior of the car is soiled in anyway, either by urine or other bodily fluids, you will be expected to pay for the soiled area(s) to be cleaned and for the cost of any lessons that have had to be cancelled as a result. In addition, during driving tests, the examiner will not prevent you, the candidate from hitting the kerb or causing other similar minor damage to the car. Therefore, all damage caused by you whilst on test will be charged to you (up to the level of excess on the instructor’s insurance policy).

Privacy:

1. L-Drivers Ltd is committed to protecting your privacy. We will only use the information that we collect about you lawfully – in accordance with the Data Protection act 1998.

2. Any personal information which we hold to process your booking will be held securely in accordance with the law, and will not be sold or passed on to a third party.

You must bring the following with you to your test:

Your valid signed GB (or Northern Ireland) photocard licence – both the photocard must be presented, or, your old style valid signed GB (or Northern Ireland) paper driving licence and valid passport; (holders of non-UK passports should check that they are eligible to take a driving test here). It is a legal requirement to produce your licence and photographic evidence. If you do not bring these items with you, or you are late for your test, you will not be allowed to sit your test and you will lose your fee.

Re-schedule Policy:

If you need to reschedule your test, you must allow at least three clear working days before your test date, to avoid losing your fee. For example to reschedule a test booked for a Friday you must inform us on the previous Monday.

Payment Terms & Cancellation Policy:

Lessons must be paid for in advance and no later than 2 hours prior to start of the lesson. Payment will be taken via PayPal using it's credit / debit card handling facilities and secure payment gateway.

If you need to cancel your test, you must allow at least three clear working days before your test date, to avoid losing your fee. For example to cancel a test booked for a Friday you must inform us on the previous Monday.

Complaints Procedure:

If a pupil wishes to make a complaint against L-Drivers Ltd or any of it’s direct employees, that complaint must in the first instance be made in writing and sent via electronic mail (email) to L-Drivers Ltd’s head office, as soon as is practicably possible and no later than 14 days after the date of the pupil's last lesson. We cannot be held responsible, or act accordingly, if a complaint has not been submitted in this manner.

Our vehicles are fitted with internal cameras which record both audio and imagery to safeguard both pupil and instructor. These cameras are capable of storing up to 3 days worth of recordings. Should a complaint be received via email, and it is within this 3 day period, we will look at and use any available recordings as evidence relating to that complaint. We take complaints very seriously and will make every effort to rectify any issue if it is in our power to do so.
